1. Services Provided
CurbSide Websites provides website design, development, hosting, and related services for small businesses. We offer a free website preview, followed by paid plans (Standard and Premium) if you choose to activate and claim the website.
2. SMS Communications (A2P 10DLC Compliance)
By providing your phone number and opting in via our website forms, you consent to receive SMS text messages from CurbSide Websites.
- Program Description: We send SMS messages related to your website preview, account updates, service notifications, billing, and occasional promotional offers.
- Message Frequency: Message frequency varies based on your interaction with our services and the status of your website build.
- Pricing: Message and data rates may apply depending on your mobile carrier plan.
- Opt-Out Instructions: You can cancel the SMS service at any time. Just text "STOP" to the shortcode or number from which you received the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- Help Instructions: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at [email protected].
- Carrier Liability: Carriers are not liable for delayed or undelivered messages.
- Consent: Consent to receive SMS messages is not a condition of purchase.
3. User Responsibilities
You agree to provide accurate, current, and complete information when requesting a website preview or purchasing our services. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
4. Intellectual Property
All content, design, graphics, and code created by CurbSide Websites remain our intellectual property until full payment is received for a live website plan. Upon payment and activation, you are granted a license to use the website for your business purposes. We retain the right to use the completed website in our portfolio and marketing materials.
5. Payment and Billing
Payment for our Standard or Premium plans is required before the website is fully activated on your custom domain. All fees are non-refundable unless otherwise stated in a specific written agreement. We use Stripe for secure payment processing.
6. Limitation of Liability
To the fullest extent permitted by law, CurbSide Websites shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.
7. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
8. Changes to Terms
We reserve the right to modify or replace these Terms & Conditions at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
